Terms of sale

The online store at chinauto.pl is operated by CHINAUTO.PL (seller details below). These terms apply to every customer — both consumers within the meaning of Article 22¹ of the Polish Civil Code and businesses placing orders in the course of their trade.

Wherever these terms refer to a "Customer", this means both a consumer and a business, unless a specific provision applies to only one of these groups.

An order can be placed via the quote form, by email, or by phone, providing part numbers, vehicle details (a VIN is best) or OE/OEM numbers. A quote we send does not constitute an offer under the Polish Civil Code, only an invitation to place an order — the binding price and delivery time are confirmed only when we accept the order.

A contract of sale is concluded once the Seller confirms acceptance of the order in writing (including by email). Until then, the Seller may decline to fulfil an order, in particular if a part is unavailable from a supplier or its price has changed.

A quote sent by email or through the site form is valid for 7 days from issue unless stated otherwise.

Catalog prices are shown net in EUR and are indicative — they may change before an order is confirmed, since they depend on current supplier availability and pricing. The price that applies is the one stated in the order confirmation.

VAT is added to the net price at the rate applicable on the invoice date, plus delivery cost where applicable, shown separately in the quote. Payment methods and terms are described on the Payments page.

Orders are shipped by courier within Poland and by air or land freight abroad — timelines and costs are described on the Delivery page. The estimated delivery time given at order confirmation may change for reasons outside the Seller's control, e.g. carrier delays or force majeure.

A Customer who is a consumer — and a sole trader making a purchase not directly related to their professional activity — has the right to withdraw from a distance contract within 14 days of receiving the goods, without giving a reason, under the Polish Consumer Rights Act of 30 May 2014.

To exercise this right, send an unambiguous withdrawal statement to [email protected] before the deadline. Returned goods must be sent back promptly, no later than 14 days after the withdrawal statement, in a condition that does not exceed ordinary use for checking the goods. The Customer bears the cost of return unless the Seller states otherwise.

The right of withdrawal does not apply to parts sourced or selected for the Customer's individual order (e.g. matched to a supplied VIN, in a non-standard configuration, or not normally stocked in our catalog), nor in the other cases listed in Article 38 of the Consumer Rights Act. It does not apply to orders placed by businesses in the course of their professional activity.

The Seller refunds the full price of the returned part together with the cost of the cheapest standard delivery method offered in the Store, even if the Customer chose a pricier delivery option when ordering (Article 33 of the Consumer Rights Act) — the Seller does not refund the difference for a pricier option. If the order was placed under a "free delivery" promotion, no delivery cost is refunded.

If the returned part has been installed, soiled (e.g. with grease or oil), or has otherwise lost commercial value beyond what is necessary to establish its nature and characteristics, the Seller may deduct an amount corresponding to that loss of value from the refund.

These rules apply only to withdrawal where the part itself is sound and the Customer simply chose the wrong one. If the part is defective or does not match the description on the site (e.g. an incorrect vehicle-model fitment was stated), the statutory warranty (rękojmia) described in "Statutory warranty and manufacturer's guarantee" applies instead — in that case return shipping in both directions is borne solely by the Seller.

Independent of the voluntary manufacturer's guarantee described on the Warranty & returns page, the Seller is liable to consumers for defects in the goods sold under the statutory warranty (rękojmia) rules of the Polish Civil Code. Making a guarantee claim does not exclude, limit or suspend a consumer's statutory warranty rights.

For business customers, statutory warranty liability may be limited or excluded under separate commercial arrangements.

OE/OEM numbers shown in the catalog are for identification and comparison only — full compatibility with a specific vehicle is confirmed only by the OE number found in the vehicle's documentation or on the part being removed, as described on each product page.

The Customer is responsible for providing accurate vehicle details (make, model, engine, VIN) when ordering. The Seller is not liable for a mismatched part where this results from incorrect or incomplete details supplied by the Customer and the selection was not previously verified by the Seller's team.

This site is an independent spare-parts catalog. Vehicle manufacturer names, brands, model names and OE numbers are used solely to identify vehicles and to state the intended fitment and compatibility of the products offered. The Seller is not affiliated with, or authorized by, any vehicle manufacturer unless a specific product description states otherwise — all trademarks mentioned belong to their respective owners.

Some of the replacement parts offered visually match original parts protected as the vehicle manufacturer's registered design. The terms of selling and fitting these (the so-called repair clause) are described on the relevant product pages.

To the extent permitted by applicable law, the Seller's liability to business customers is limited to the order value and excludes lost profits or indirect damages, in particular from vehicle, workshop or fleet downtime. This limitation does not apply to damage caused intentionally.

The Seller's liability to consumers is not limited beyond what is permitted under mandatory provisions of law.

The Seller is not liable for failure or delay in performing its obligations due to force majeure, including acts of nature, government decisions, supply-chain disruptions, and carrier actions outside the Seller's control.

Disputes with consumers are resolved by the court having jurisdiction under the Polish Code of Civil Procedure. A consumer may also use out-of-court complaint resolution, including the EU's ODR platform at ec.europa.eu/consumers/odr, or contact the relevant regional Trade Inspectorate.

Disputes with businesses are resolved by the court with jurisdiction over the Seller's registered seat. Contracts are governed by Polish law.

The cart, wishlist, product comparison and recently-viewed history are stored locally in the Customer's browser and do not by themselves constitute placing an order. Their contents may be lost if browser data is cleared or a different device is used.

The Seller reserves the right to amend these terms for good cause, e.g. a change in the law, in the services offered, or in the store's technical setup. The revised terms are published on this page with reasonable notice and do not affect orders placed before they take effect.

If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in effect. Matters not covered by these terms are governed by Polish law, including the Civil Code and the Consumer Rights Act.
